Woman Loses Job After Hyrox Competition During Sick Leave, Employer Wins in Court
A canton court judge ruled that a Tilburg real estate agent was rightfully dismissed for participating in a Hyrox fitness race while on sick leave. The employee had claimed Pfeiffer’s disease prevented her from working due to fatigue, yet she competed in Mechelen in March. The judge determined the dismissal was justified not because of the sport itself, but due to a breach of trust caused by providing an inaccurate picture of her health status. Despite losing her job, the woman is entitled to a transition payment of 877.50 euros and over 2,500 euros in unpaid wages and holiday pay. Conversely, the employer received 2,106 euros in damages, significantly less than the 19,000 euros sought, and the employee must repay 153.90 euros for excess vacation days taken.
