Former Martinair Cargo Pilots Entitled to Back Pay from KLM
The Amsterdam Court of Appeal ruled that approximately 250 former Martinair cargo pilots are entitled to back pay from KLM for the period between January 1, 2014, and January 1, 2022. The dispute concerned the transfer of Martinair’s cargo division to KLM, which a previous court had deemed improper. While the appellate court rejected the pilots' claim to apply KLM’s collective labor agreement and pension scheme retroactively, it affirmed their right to compensation because KLM failed to employ them starting in 2014.
