Can Pension Indexation Be Enforced Through the Courts?
A Rotterdam court ruled that ExxonMobil pensioners are entitled to retroactive indexation from October 1, citing a breach of good employer conduct. Although the ruling was temporarily withdrawn for correction, it confirms that retirees can successfully sue for missed adjustments when specific contractual agreements exist. While general rules do not grant an enforceable right to indexation, ExxonMobil had agreed in 2005 to compensate for at least 90% of inflation. The company deviated from this between 2021 and 2024 due to high inflation but failed to adjust pensions in 2024 while active workers received raises. The court capped the adjustment at 5.8%, sparing the company an estimated 100 million euro liability. ExxonMobil plans to appeal, arguing that pension schemes vary by case. Other companies like FrieslandCampina and John Crane have also seen successful legal actions regarding indexation.
