Parents Apply Legal Pressure on the State: Lawsuit Threatened Over Children Stuck at Home
The parents' association Balans has sent a legal letter to the Dutch State, demanding concrete solutions for the thousands of children currently unable to access appropriate education. Supported by over 8,000 families and 48 organizations, Balans asserts that systemic failures, including staff shortages and fragmented responsibilities, prevent the realization of the right to suitable schooling. The group requests negotiations by October 8, aiming for binding agreements by December 24. If the State refuses to engage or fails to provide adequate measures, Balans plans to file a collective action under Article 3:305a of the Civil Code, assisted pro bono by Loyens & Loeff and PILP. Director Joli Luijckx emphasized the goal is ensuring every child can learn in a way that suits them, rather than pursuing litigation for its own sake.
